THE PROCESS OF FILING BANKRUPTCY

  • Take advantage of our “FREE CONSULTATION” by calling to make an appointment.  Upon calling, we advise you to bring personal information about your finances, income and family etc. (see tab for documents needed).
  • The answers you provide are necessary in preparing your bankruptcy.  Also you will be given information concerning a Credit Counseling certificate (this is the first of two certificate needed by the courts – to file and receive a discharge).
  • Once retained, your bankruptcy will be prepared.  Another appointed will be scheduled to come back and sign documents.
  • Documents are filed with the courts – the courts will notify each creditor.
  • A Trustee is assigned to your case
  • Within 30 days, a 341 creditor meeting is set.  All Parties must attend with driver’s license and social security card.
  • Usually 3-6 months after 341, debtor is discharged in a chapter 7.  A chapter 13 is discharged after 3-5 years when the plan is completed.
